Jason Sudeikis and his ex-partner Olivia Wilde are being sued by their ex-husband, who claims the couple fired her because of her mental health issues.
Ericka Genaro said she suffered “a lot of anxiety” and stress following the couple’s split in 2020, which ultimately became “harmful”.
In court documents filed in Los Angeles on Tuesday, Ms. Genaro alleged that during late-night conversations with Sudeikis, she felt she had to “clearly choose sides” between the two parents.
“Wilde’s sudden absence from the home adversely affected her emotional state, including Sudeikis leaning on (Genaro) for support,” read the complaint, obtained by the PA news agency.
“Plaintiff became increasingly concerned and stressed with Sudeikis’ tendency to require Plaintiff, apparently, to stay up at night after the children were put to bed to talk, but that dynamic did not occur before Wilde was absent.
“The subject of these late night conversations with Sudeikis naturally arose and talk about Wilde which the Complainant felt she had to deal with despite causing her great anxiety because she apparently felt she had to ‘ to pick sides’ between the parents of the children she was in. apparently the main carer.”
The filing also said Ms Genaro’s anxiety over the next few months was “increasing” and was exacerbated by media coverage of the couple’s separation.
Ms Genaro later alleged that after informing Sudeikis of the need for a three-day medical leave of absence – recommended by a doctor – the actress “terminated her on the spot”.
“The plaintiff is informed and believes, and alleges, that her termination was terminated because of her anxiety/depression disability, and for seeking a reasonable accommodation for a three-day leave of absence,” a the filing said.
Ms. Genaro has filed a case for wrongful termination on the grounds of disability discrimination.
Representatives for Sudeikis and Wilde have been contacted for comment.
The Hollywood couple were together from 2011 until the end of 2020 and are parents to son Otis and daughter Daisy.
Wilde previously accused Sudeikis of “threatening” her when she served legal papers on stage at an event in Las Vegas last year.
She claimed that the actor could have delivered the documents “discreetly” but chose to do so “in the most aggressive way possible”.
